For Collecting Written Offers for Leasing Out

the Business Premises in the Faust Vrančić Memorial Centre Building

in Prvić Luka

1. SUBJECT OF THE TENDER, BUSINESS ACTIVITY - INTENDED USE OF THE PREMISES, INITIAL LEASE FEE AND LEASE DURATION

Business Premises at the Faust Vrančić Memorial Centre in Prvić Luka, specifically:

- intended use of the premises: retail activities (sale of bakery goods)

- initial lease fee: 191.20 HRK/month (4.78 m2 x HRK 40.00)

- lease contract to be concluded for a duration of 5 years

2. COMMENCEMENT OF PAYING THE LEASE AND USE OF THE PREMISES

The lessee is obliged to pay the lease fee for the business premises which are the subject of this tender, commencing on the day of concluding the Contract on Leasing the Business Premises.

3. GUARANTEE AMOUNT (GUARANTEE DEPOSIT) AND MANNER OF PAYMENT

The guarantee amounting to HRK 11,685.04 (double the amount of the initial monthly lease fee) is to be paid to the IBAN or account number of the recipient: HR9824110061191000795, along with payment model HR 00 and reference number: 03-14-OIB of the tenderer, for the purpose of paying the "guarantee for leasing the business premises in the Faust Vrančić Memorial Centre” with the designation that the chosen tenderer loses his right to a refund of the deposit in the event that the he fails to conclude the Lease Contract or if he fails to provide the surety instrument as stipulated by the tender. Upon concluding the lease contract, the guarantee deposit of the chosen tenderer is retained and goes towards the lease fee, whereas other participants are to be refunded their deposits;

4. DEADLINE FOR SUBMITTING WRITTEN APPLICATIONS FOR PARTICIPATING IN THE TENDER

- Applications are to be submitted within 8 days of the day of publishing the Notice of Commencement of the Tender in the media, specifically as of 8 June 2016

5. DATE, PLACE AND TIME OF PUBLIC OPENING OF OFFERS

- The public opening of offers will take place on 17 June 2016, starting at 1 pm in the Vodice Town hall.

6. CONDITIONS OF USE FOR THE BUSINESS PREMISES

- The lessee shall not sublease out or cede the business premises or part of business premises to any other person or user, nor undertake external or internal works or reconstruction, nor adaptation or change of business activity, without express written consent from lessor

- The lessee is obliged to take care of the business premises with the due diligence of a good businessperson

7. GENERAL PROVISIONS

- The tender is conducted by collecting written offers in sealed envelopes.

- The business premises may be inspected any working day during working hours, by telephoning 022 448 128;

- The most favourable bidder shall within 15 days of the Decision on Making the Selection or prior to the deadline as determined by the Mayor, physically assume the business premises and conclude a lease contract, i.e. if the most favourable bidder fails to act as stipulated, it will be deemed that the bidder has withdrawn from signing the lease contract, and the tender for the business premises will be repeated;

- The bidder that has unsettled debts towards the Town of Vodice, i.e. towards the state budget, may not participate in the public tender;

- The most favourable bidder that will lease the business premises shall prior to concluding the Lease Contract, submit a blank promissory note certified by a notary public covering the yearly amount of the contracted lease fee, and which will be monetized in the event that the lessee during the term of the contract or upon expiration of the Lease Contract fails to settle due lease fees and other costs.

- The costs of ongoing maintenance is to be borne by the lessee

- The conditions from this tender relate also relate to persons referred to in the Act on the Rights of Croatian Defenders from the Homeland War and Members of Their Families (Official Gazette, no. 174/04, 92/05, 02/07, 107/07, 65/09, 137/09, 146/10, 55/11 and 140/12) who fulfil the conditions from the tender and accept the highest bid amount have the first of right to conclude the Lease Contact for the business premises.

- The Faust Vrančić Memorial Centre retains the right not to accept any offer without providing further explanation.

The written application for participating in the tender must contain:

1. Application for the tender with the name of the legal person and registered address, OIB and bank account number.

2. Copy of the decision on registration in the court, business or other register,

3. Certified copy of documentation that provides evidence of the right of priority according to the Act on the Rights of Croatian Defenders and/or Members of Their Families,

4. The offered monthly unit amount for the monthly fee (based on m2),

5. Proof of payment of the guarantee,

6. Confirmation of the non-existence of debt towards the Town of Vodice,

7. Confirmation from the Tax Administration of the non-existence of debt towards the state budget, or approval for deterred payment of obligations and adherence to the payment deadlines.

8. The original or certified copy of the Certificate of no Criminal Record issued by the relevant court and not older than three (3) months.

The application is to be submitted within a period of eight (8) days from the date of publishing the Notice of Commencing the Tender in the daily print, in a sealed envelope and addressed to the FAUST VRANČIĆ MEMORIAL CENTRE, PRVIĆ LUKA BB, 22 233 PRVIĆ LUKA, and designated as "DO NOT OPEN - APPLICATION FOR THE TENDER FOR LEASING THE BUSINESS PREMISES”.
